Verizon to AT&T: 'The truth hurts'

The No. 2 telco responds defiantly to AT&T's claims that its ads are false and misleading

"AT&T did not file this lawsuit because Verizon’s 'There’s A Map For That' advertisements are untrue; AT&T sued because Verizon’s ads are true and the truth hurts."

So begins Verizon's (VZ) legal reply to a pair of lawsuits filed earlier this month by AT&T (T) demanding that Verizon pull five disputed ads from the air. The issue: a pair of 3G coverage maps that AT&T claims are "false" and "misleading" and are causing it "irreparable harm" as the two companies enter the holiday selling season.

The 53-page filing lays the factual basis for the ads and concludes its introduction with a  paragraph that gets to the heart of AT&T's problem: its failure to prepare for the success of Apple's (AAPL) iPhone, for which it is the only authorized U.S. carrier.

"In the final analysis," the introduction concludes, "AT&T seeks emergency relief because Verizon’s side- by-side, apples-to-apples comparison of its own 3G coverage with AT&T’s confirms what the marketplace has been saying for months: AT&T failed to invest adequately in the necessary infrastructure to expand its 3G coverage to support its growth in smartphone business, and the usefulness of its service to smartphone users has suffered accordingly. AT&T may not like the message that the ads send, but this Court should reject its efforts to silence the messenger."

The document is available as a PDF here.

Eh? My blackberry has gsm and CDMA. Can't do that with ATT

Posted By Anonymous: January 25, 2010 2:27 PM

CDMA is actually a newer technology than gsm, gsm is just more globally used. Currently vodaphone in europe and verizon in the us are transitioning to a new tech called LTE.

Posted By California: December 30, 2009 7:46 PM

Ok $45 for unlimited talk, texts, and data is false. To get unlimited calls cost twice that alone. Also you guys are pretty pathetic for wasting your life on here. I went on here to read the article that's it. Avertising is that, you can claim your network is that big but you read the small print and says some area don't work. Both networks are this was. But verizon is worse about it late. Trust me if verizon got the iPhone they would have alot of network problems. They just haven't seen a phone that is going to use this much data. AT&T has survived it for almost 4 years. AT&T has alot of work to do but they are a work in progress.

Posted By Bill Nye: December 15, 2009 10:18 AM

Unfortunately, VZ uses CDMA and old, and cheap technology that was the first introduction of mass cellular in the US. Virtually all other global locations use GSM, just as AT&T and T-Mobile use. As such VZ is useless for people that travel.

T is investing 16 Billion/year in keeping up/expanding their network – look it up. Coverage will be there.

Posted By B Smith, Ft Lauderdale FL: November 24, 2009 9:47 AM

Customers need to know the truth about claims companies are making before they decide to get locked into a 2 or 3 year contract. Many times you won't know if a service is great in your area or not until too late.

WOW judges already made a preliminary decision and guess what it's on the side of Verizon! hooray :D

Actually after the hearing, AT&T made a a loser video, and they even used Luke Wilson to made the ridiculous video. One of the reason why this advertisement failed to give
impact on viewers coz it sounds too farfetched/ wrong timing and guess what? Copycat to the "there's an app for that ads"

AT&T IS A LOSER: SIDE BY SIDE advertisement

Thanks for this post!

We all know that Verizon has better coverage in the USA and AT&T should just accept that they have to up their game to improve their network. I have a Straight Talk prepaid phone which runs on Verizon's network nationwide so I get the benefit of the best network with the cheapest rates. I have the unlimited talk, texts and data for $45 per month and there is no iPhone worth paying three or four times that amount every month.

Posted By ashersimons: November 19, 2009 9:18 AM

As an iPhone owner (and thus an AT&T customer) I see AT&T's lawsuit as the wrong approach. I had been a Verizon Wireless customer (as far back as the days of a predecessor company named AirTouch Cellular) from the time I had purchased my first cell phone until the purchase of my first iPhone.

Living in the massive and sprawling metropolis often called Los Angeles I've experienced no difference in service quality between AT&T and Verizon. The few spots of shoddy coverage I've experienced with AT&T are strangely reminiscent of the spots where the Verizon signal was problematic (isolated spots along the 5 and 14 freeways no matter the strange looking faux palm trees serving as cell towers along the road). User experiences outside major metropolitan areas may be much different.

That said, in my view the court case can only benefit Verizon at AT&T's expense. A win in the case won't make AT&T's service any better and a loss will only benefit Verizon's campaign and that company's efforts to promote itself as a superior service provider.

I think this battle is best fought in the marketplace with the two companies dueling it out for the best combination of handsets and services. In fairness to AT&T I don't think Verizon's network would have held up much better if it was the exclusive carrier for the iPhone considering how much us iPhone users splurge when it comes to data demand.

Still, let the marketplace determine a victor, not the courts. If AT&T doesn't like Verizon's depiction of its 3G coverage map, invest more and invest more quickly. In other words, change it.

"We are just telling the truth and the truth hurts" Seeing the minced version of the 53 page statement of Verizon. I must say, I could be on the side of Verizon. The end result of this heated debate should be very interesting.

AT&T VS VERIZON: TRUTH REALLY HURTS

Thank you brainstorm tech for giving us updates

Posted By Jaimes, Chicago: November 18, 2009 10:25 PM

Verizon has- by far – superior coverage. And to those of you that criticize their advertising, it addresses the only part of wireless service that matters – the coverage. Carriers can meet each other's pricing plans, offer comparable phones, etc. It is the coverage that matters. The whole idea of roll over minutes is a consumer mirage if I ever heard of. I will keep giving you back something you never used and keep adding it to the more of what you didn't use, and keep doing it and convince you it has real value. That is like buying a 1/4 pound hamburger instead of 1/3 pounder at the same price because 4 is higher than 3. Consumers continue to prove that they are less than intelligent. Service quality is all that matters.

Posted By jac, bloomfield hills, mi: November 18, 2009 8:09 PM

So….

I wonder, if I call someone with my At&T phone to their Verizon phone, "If they can hear me NOW"

Answer… NO, because AT&T keeps dropping my calls! Thats why they give us soooo many ROllOVER MINS, so we can use them to call back all of the drop calls!!!

Interesting number of people from Texas defending AT&T. Wouldn't happen to be because that is where they are based out of now is it.

Guys, lets not get started on FIOS vs Uverse, another technology Verizon absolutely destroys AT&T on. Why not sue them for that too? How dare they claim fiber is faster than VDSL.

Posted By Scott, DC: November 18, 2009 5:42 PM

Looks like the legacy monopolistic AT&T is back with vengeance.

First off, what sort of stooges does AT&T have running that company? To think that they can sue a competitor for pointing out the truth.

If AT&T can sue for this, then Microsoft should be able to sue Apple into submission.

Isn't the REAL ISSUE with a CORRUPT US CONGRESS, taking money to ALLOW VZ and T to SCREW YOU BLIND?? Look how many GERIATRIC MILLIONAIRES got that way, from 20, 30, 40 YEARS of pandering in Congress….and YOU, keep sending them back as a REWARD. Maybe it's the voters who are AT FAULT…VOTE WISELY in NOV 2010 and 2012!!! KICK OUT the Pelosis, Dodds, Franks, Reids, and about 200 crooked Repubs TOO!

I have had AT&T in Texas (Dallas, College Station, & Houston) for over 10 years. 99.9% of my calls are perfect. I get reception in basements and in the middle of no where, even when friends with Verizon can't. AT&T has an amazing network, and my iPhone works lightning fast with 3G all over the state.

I never have problems, but everyone I met with Verizon seems to. A little ironic…

Posted By Daniel, Houston, TX: November 18, 2009 11:52 AM

I worked for AT&T in the early 2000's and the coverage was so bad all the sales guys had Verizon phones so we could get and make calls while on the road. Biggest joke in the office.

Posted By SB, Ewing, NJ: November 18, 2009 11:49 AM

"More bars in more places" and "the internet cannot hide anymore". What a joke! AT&T Mobility is simply a pathetic greedy company. As a former AT&T employee I was surprised to learn how they neglect their network. Dirty circuits relates to drop calls, and their list of dirty circuits in their switches goes through the roof. And who takes care of it? Nobody does, because their fat and lazy Network Operations Center techs along with switch techs are too busy complaing of how they are getting screwed. And they should be complaing because AT&T and their partnership with the union Communications Workers of America decided that they should pay workers 20% below market rates and pocket the difference 50/50.

Posted By Unknown: November 18, 2009 10:59 AM

Do any of you have a phone from Verizon that "supposedly" does mobile "live" tv? If so, does it work anywhere outside of the DC metro area? If you say it does, I say you are not telling the truth, because that it the only market that the service is truly offered in. Verizon talks a good game, saying that they have all their services available everywhere. Do not believe it. I used to work for them, and I know. They sell the same phones in all their stores and then sell the same plans and services for those phones, regardless if the serivces are available or not. They will rip you off and charge you an arm and a leg every month for services you can not actually use. However, with AT&T, I have never had an issue doing what, when I want, where I want. I pay a little less for AT&T and I can use my phone for any serives I want (TV, music, data, calls), no matter where I am.

Posted By Terry, Katy TX: November 18, 2009 10:29 AM

This is no surprise. When I worked at AT&T R&D and we needed cell phones for support teams we ended up using a competitor’s products and services because AT&T never had a good mobile data network. AT&T only knows how to tell customers to pay for services that AT&T cannot provide adequately and sign expense exclusivity contracts, trying to display themselves as the premier wireless carrier. AT&T is slowly becoming a T-Mobile type company; the mess that was created by poor management in the old regime is being duplicated by the new regime. AT&T just is not the innovative company it once was.

Almost every one I know with an iPhone in Atlanta has a "dropped call" problem multiple times a day. Smart phone…not so much the carrier.

Posted By Paul, Atlanta, GA: November 18, 2009 8:32 AM

I haven't had a land line for the past 6 years so my mobile provider has to be 100% reliable. I have been a Sprint customer since 2001 and have never once thought about switching. I've never had problems with customer service(seriously!!) and have had excellent coverage all over the US. Plus, I've saved a crap load of money over the years compared with Verizon or AT&T. You couldn't pay me to leave Sprint for a stupid iPhone.

Posted By ms St. Louis, MO: November 18, 2009 2:18 AM

Sadly, ALL cell phone companies suck! We are currently with AT&T but have had Sprint (cdma), Nextel (iDEN network), T-mobile, and Verizon. I honestly can't say that I've been happy with any of them. The only reason my family is with the large Death Star network is because of a corporate discount & reimbursement I get from my employer. The only other thing I can say is that I try to get my money's worth with the iPhone data plan (i.e. use as much data as I possibly can each month).

Verizon is right the 3G service for AT&T is horrible. I am waiting the day for my contract to expire so I can go to a company that actually has good coverage.

Posted By Adam, Chicago IL: November 17, 2009 6:28 PM

Stop kidding yourselves Verizon is not far superior. If they area, why are they slaming AT&T? You don't have slam someone you claims have an inferion product. The bottom line is Verizon is good as plain old cell service. There reason they lag in smartphones and gulf is getting wider. They can't provide the coverage for smartphones. All you verizon users try surfing the Net while talking. You can't do it. That's why Verizon is behind the scenes trying to get Apple to do Hybid IPhone as the so called great Verizon network can't handle the current IPhone.

Posted By rp Akron, OH: November 17, 2009 6:27 PM

Cell phone service in the U.S. is terribly expensive as a whole. I lived in Germany for four years and paid 60 Euro for unlimited land line calls and mobile to mobile to my same service with unlimited data. Here I pay $135 for the same service. Even at the current conversion rate Germany wins. But, Verizon should not be looked upon in a bad light. What they are simply doing is pointing out the obvious and what is wrong with that? Saying our network is better than the other guys…hey it breeds competition! That is at the heart of capitalism, don't whine AT&T…keep up!

Posted By Angel M. Minot, ND: November 17, 2009 5:21 PM

ATT sucks hands down I've used them for 7 yeats stright had nothing but pure frustration and nothing but dropped calls when it comes to voice service and this was in south florida, central florida, and for a years in tx too. went through about 10 different phones including the iphones. EDGE is SLOWER than 3G hands down Proven fact. 3G Was fast when it worked and had excellent all bars service besides that was SLOW too Proving fact. ATT customer service was the worst, technical support I didn't even bother to call them. And whats more I cancelled my plans years ago and just recentlly almost had heated legal argument with them because they wanted to charge me for something thats been cancelled for years now. I would try verizon but they are expenive for my needs now, I have a friend who owns the service and allow me to try out his phone for a week, no dropped calls, 3G service was quick as ever I traveled all around and never had the speeds drop out or calls drop out on me and this was on the new droid phone too. You apple fanboys get a life do your research before talking trash on the blogs that make no sense.

Posted By unknown. Austin TX: November 17, 2009 4:32 PM

if anyone else has noticed, Verizons propaganda has been to belittle their competitions services/products. for example, cell phone and now television. verizon is pathetic….although i do use their cell phone service

Posted By cjd, NY: November 17, 2009 4:28 PM

Wow: I was an AT&T customer for 8 years prior to switching to Verizon. I can tell you AT&T is GARBAGE I use my phone all over the US and many times I get dropped or have terrible reception. I switched to Verizon two years ago ( I use a Blackberry) the service has been PHENomenal, I get a few drops in far reaching places but in comparison to the AT&T drops I can deal with it. A fellow worker switched to Sprint and after one year came over to Verizon with me. I am going to purchase a droid once my next upgrade comes due. I will vouch for Verizon reliability hands fdown over AT&T. PSSSST and they are less expensive…

When my friends come to my house their Verizon phones don't work. My AT&T phone does.
Verizon's network may look good now, but if they get the Iphone, their network too will be tested. AT&T is continuing to build their network and that takes money and time. Their networks are mostly tested to capacity in cities not in other places. Verizon wishes it had AT&T's problems. The Iphone has been great for AT&T.

I have Sprint and never had a problem with Sprint service. No Dropped Calls and when I need to make a call I can and never had a problem with the bill. Customer service is excellent Now I do know that AT&T has a great network and for Verizon to compare to win the competition in a bad way is just wrong. It doesnt actually say much for the company. You dont bash a company because you want business and as far as Im concerned as verizon is concerned I was looking to switch to them but Id rather stay with Sprint "The Now Network" that doesnt bash other companies. Verizon you lost my business

Posted By ADAM-Syracuse, NY: November 17, 2009 3:28 PM

Verizon should do a little checking on its own map. I live in upstate NY in an area of solid red according to Verizon. In fact we get no service at our house and at best one bar when I stand in the middle of our road. We no longer even bother to try to use our cell phone at home.

Posted By Tom Salm, Interlaken, New York: November 17, 2009 3:21 PM

Iphone operates on GSM – so Iphones could be sold globally. The new 'rumored' Iphone will operate on 'worldband' – making it available to pretty much any carrier once the exclusivity agreements expire.
Iphones are costly and Verizon refused to subsidize their costs. While ATT may have sold a lot of phones and gained a lot of customers, these customers add very little to the bottom line. There are plenty of great phones out there… not just iphones.
wifi will be critical to the success of any handset / carrier.

Posted By dc, irving tx: November 17, 2009 2:50 PM

Complete B.S., T does not have the fastest network. If you go look at any independent network test it clearly shows AT&T, Verizon and Sprint all have very comparable speeds. T says they are doing the HSPA+ upgrades in the metros, so maybe it will be slightly faster at some point in the future, but the fact remains Verizon is already building a 4G network today that will go twice the speed.

Posted By Informed, Tulsa, OK: November 17, 2009 2:04 PM

I have had AT&T bundled service for years, with my most recent addition cellular service once my Sprint contract expired. I've now had cell service with AT&T for approximately 5 years. Suffice to say I am not going anywhere. I have been very pleased with my connectivity, and whether I've had to contact customer service relating to my cellular package or anything unless I have bundled, I have been very pleased with both the efficiency and demeanor with which my questions have been addressed. Next up, U-Verse!

Posted By Don, Chicago, IL: November 17, 2009 2:00 PM

I had AT&T many years back before Cingular bought them. They had great coverage and service. After the Cingular purchase, coverage dropped, customer service was out the door. I wonder why they switched their name back to AT&T… Cingular was horrible. I am now on VZ, never drop a call, never have issues with coverage and refuse to get an IPHONE till VZ supports it… APPLE- Take the hint, you are losing customers due to the AT&T agreement.

Remember, with big mergers the top brass and accountants only cut costs and do not worry about the employees or customers… they are only worried about their bonus… you gotta love Corp America!!!

Posted By Neil, Chicago, IL: November 17, 2009 1:45 PM

Love the comments….
dropped calls have as much to do with equipment (phone) as it does with the network. Different phones have different capabilities, such as multi tasking which is not a network issue.
Different networks have different coverage in different areas. Iphone (GSM) cannot work on the Verizon CDMA network (yet-new model will). Also, ATT has an exclusivity agreement – due to expire next year.

Biggest item to keep an eye on will be the frequencies and lack of additional available bands. Smartphones (3g) use 30x regular bandwidth. Carrier who can offer a blend of wifi / microcells and overall network coverage will be the winner. You can also expect 'metered usage'.

All of the above favors Verizon.

Posted By dc, Irving, Texas: November 17, 2009 1:35 PM

Fact of the matter is, no coverage is 100%, and no one needs 100% coverage, just as long as good coverage is present where they live and where they go to most of the time.

I don't take "coverage" like I am married to it. I dumped Verizon because it got too expensive and phone selection is terrible. I also roam the earth and so GSM is more important than CDMA.

Life is too short. Just go with whatever that makes you happy, not what the ad says.

Posted By Andrew, Seattle, WA: November 17, 2009 1:18 PM

I don't have AT&T or Verizon (for my cell service). But I won't ever trust a thing AT&T says because I used to work for them and the laid me off and sent my job to India. I thought the "A" in AT&T stood for "American."

I've had Sprint for years. It's the #3 network – which means NO ONE IS ON IT. You can get a Palm Pre or Blackberry Tour on Sprint and it FLIES. Plus, you don't seem like a pretentious douche with an iPhone.

Posted By Adam. Tampa FL: November 17, 2009 12:51 PM

The ads are false and misleading. The ATT edge network and 3S are faster than Verizon 3G and those networks are all over the country. If Verizon wants to talk about truth. Why don't you tell you customer how you network can't handle the IPhone? Or better yet show a Verizon customer talking and surfing at the same time? They can't show that.

Posted By R.Randle, Marietta, GA: November 17, 2009 12:45 PM

I do a lot of computer work out on the eastern end of Long Island and I have to say that the data card I used from AT&T had no signal at all. When I switched to Verizon, I've had no problem in the same location.

Posted By Hector Stamos, Montauk, NY: November 17, 2009 12:38 PM

AT&T service is terrible. I was convinced to bring my number into an AT&T family plan, not a day goes by that I don't get a dropped call. I have had 4 different phones from 3 different manufacturers and have traveled up and down the east coast and have had service troubles on a daily basis. It took us two weeks to get their customer service snafu fixed when we got new phones. Since I get it for free I put up with the poor service. If I had to pay I would NOT continue with AT&T. Verizon's only pointing out the terrible cell phone service that AT&T provides, nothing but the truth.

Posted By Tallahassee, FL: November 17, 2009 12:35 PM

Love it. Just love it. As an iPhone user I totally agree and think AT&T deserves it. They should of thought about their consumers. Oh….. Wait they're not in that business either!

Posted By Bill: November 17, 2009 12:33 PM

In our area, VZ works great, while AT&T has been know to have spotty service and dropped calls. Like I said before, I will get an iPhone when I can get it on VZ's network. That would be the best of both worlds.

Att fanboys have nothing better to do than to sit around and talk how about how att and iphone is king of the world. I personally tried Att for a year and hated it, dropped calls like crazy, switched phone 3 times one of them being the iphone. Didn't like it. edge service is more like a 2g service its slower than 3g servie. And the 3g service service wouldn't stay connected every I went. I was more frustrated than anything else. Than with the rude customer service from att I just ended cancelling everything and going with another provider whom is decent and providing my needs. You fanboys need to get a life and stop hiding the true facts about this worthless company.

Posted By Unknown. Austin TX: November 17, 2009 12:09 PM

I work for Verizon (communications) and have a family talk plan on AT&T. I also have Verizon as my work cell. In my case AT&T serves me better. If I'm paying the bill I want the one that gives me better service for my money.

Posted By MP, Central, NJ: November 17, 2009 12:06 PM

I can't judge map graphics or claims – all I know is that we moved from Verizon to ATT iPhones and our coverage improved 100%. More than 50% of our Verizon calls ended in a dropped call. That's my families "truth".

Posted By J. Crawford,Mahopac, NY: November 17, 2009 12:03 PM

At&t should juyst point out customer service… show a map of angered verizon customers, paying FOR every single little thing and then fighting cause they didn't use it, or there plan said differently… and then at&t with its good customer service, cheaper plans, and everything else… keep the same colors… verizon uses red in its commericals, and points at&t as blue… and i'm sure people will get the idea!

Posted By George, Cincinnati, OH: November 17, 2009 11:50 AM

Come on just admit it, even if you have an iPhone and love it it is not an excuse for AT&T's terrible coverage even in very populated areas.

I WAS an AT&T customer for years and I waited and waited for the "never showed up improvements".

All the talk about speed is non-sense, –I'll give ya the overseas calls and the iBloat– but AT&T should bite the bullet and at least get the goddam voice to work.

Posted By NoAtt FourMe, Boston: November 17, 2009 11:45 AM

Don't like either company. They both treat customers like trash. I tried both and they are equally horrible companies. I am glad I am with SPRINT. In the years since I switched to Sprint, I never had any issues at all and their pricing is much better. Also, they DON'T LIE about the used minutes like verizon and at&t did.

Posted By Elizabeth, Greenville, SC: November 17, 2009 11:41 AM

It's a win-win for Verizon. They can hurt AT&T with this now, and then when VZ gets the iPhone next year they can trumpet that they have both the best phone (finally) and the best coverage (albeit SLOW coverage).

iPhone traffic on AT&T (much multimedia) is far more than BB and others (much texting). Dunno but perhaps Verizon service may degrade with sudden and accelerating growth of better multimedia smartphones? Verizon dumb-phone user so far.

Re: Tim comment, "I'm tired of these "Evil or Lesser Evil" choices." Our 3rd choice (in NJ) just didn't have the resources to compete with the top two behemoths. That's a largely untold story, but 'nuf said about politics.

Posted By David Metuchen, NJ: November 17, 2009 11:08 AM

To bad you cant talk and surf on the VZ network like you can on T's 3G. Plus the speed is much better with T and only getting faster VZ can talk about 3G or LTE coming but for most of us now and in the near future VZ has alot of catching up to do and alot of spending. Also my ATT phone works well overseas cant do that with VZ.

Posted By James, Sebastian FL: November 17, 2009 10:48 AM

The maps may be "true", but they are misleading. The "3G" services being mapped are not the same service, and the maps are binary: service/no service. AT&T should invest the money to prepare maps to show bandwidth available per subscriber. I suspect VZ's map would then shrivel away somewhat by comparison to AT&T's.

That's not to say that AT&T don't have coverage problems, nor VZ far less data use than they'd like.

Gosh, you know what? I just can't seem to care about either of these companies, or any of the other companies you could name. Verizon has better coverage – AT&T is expensive but they won't nickel and dime you to death….but it is always the lesser of the evils when it comes to cell phone companies. When will we get a "Good" vs "Evil" choice? I'm tired of these "Evil or Lesser Evil" choices.

AT&T should save the money on lawyers and spend it on increasing their network coverage area!

Yes, and it's map of both Edge and 3G are huge covering most of America. Not a big deal unless you think you HAVE to have 3G. Edge works just fine…

Look at AT&T *OWN* map, it looks like Verizon has 5 *TIMES* the 3G coverage.

AT&T has since deleted their map from their website.

Steve Jobs, goes the old joke at Apple, is surrounded by a reality distortion field; get too close and you might believe what he's saying. Apple has made believers out of millions of customers — and made a lot of investors rich — but Elmer-DeWitt believes that an ounce of skepticism never hurts when writing about the company. He should know. He's been covering Apple – and watching Steve Jobs operate — since 1982.
